When Am I Entitled to Flight Delay Compensation?
Passengers flying to or from the European Union have more protection than almost anywhere else in the world. The EU Regulation Nr. 261/2004, also known as the "Air Passenger Rights Regulation," establishes the circumstances under which air passengers are entitled to compensation.
In the event of a flight delay, the most important requirements are that you arrive at your final destination with at least a 3-hour delay and that the airline is at fault.
Do you meet these requirements and are eligible for flight delay compensation? Then consider how much money you are entitled to:
All short-distance flight delays of 1,500 kilometres or less: 250 EUR per person
Internal EU flight delay (medium and long-haul) of more than 1,500 kilometres: 400 EUR per person
Flight delay outside the EU (medium and long-haul) - between 1,500 and 3,500 km: 400 EUR per person
Flight delay outside the EU (over 3,500 km): 600 EUR per person

Take note: The distance is calculated from the first departure airport to the final destination airport if your journey includes multiple flights.
If your flight was delayed for less than three hours, the Air Passenger Rights Regulation still protects you:
- If the flight is delayed by two hours or more (short-haul), the airline must provide free drinks and snacks.
- Passengers have the right to care if their flight is delayed by three hours or more (medium-haul) (Mittelstrecke). Two free phone calls, fax messages, or e-mails are included.
- Delayed arrival or arrival time of 3 or more hours €250 - 600 per person
- Passengers are entitled to drinks and snacks if their flight is delayed for four hours or more (long-haul).
- Delays of 5 hours or more (all distances) allow passengers to cancel their flight. The airline must fully refund all ticket costs.
- Passengers who are delayed overnight (departure the next day) are entitled to one night's hotel accommodation, including transportation to and from the airport.

How Long Can Compensation Claims Be Filed?
If your flight originated or landed in the United Kingdom, your claim is valid for 6 years. Even if your flight occurred more than 6 years ago, you may still be eligible to file a claim. The 6-year period begins at the end of the year in which the incident occurred; for example, if your flight was cancelled on January 1, 2013, you can still seek compensation until the end of 2019.
Each EU member state has its own rules regarding the validity period. The good news is that most countries allow you to submit your claim within a reasonable time frame.

What Constitutes "Extraordinary Circumstances"?
Those of you who have ever tried to lodge a direct complaint with an airline will be familiar with the phrase "extraordinary circumstances." This is because airlines frequently use extraordinary circumstances to avoid paying compensation.
Extraordinary circumstances, on the other hand, are more than a free pass. Sometimes events occur that are completely beyond the airline's control. Bad weather, air traffic control, crew sickness, strikes outside of the airline (e.g., public transportation strikes), lightning strikes, and bird strikes are all examples of extraordinary events under UK law.
